What exactly is an AFSS?

An Annual Fire Safety Statement (AFSS) is a legal certificate that confirms every essential fire-safety measure (EFSM) in your building has been inspected, tested and maintained to the standard listed in your Fire-Safety Schedule.
Under the NSW Environmental Planning & Assessment Regulation 2021, most commercial, industrial and multi-residential buildings must lodge an AFSS annually with their local council and Fire & Rescue NSW.

Why does NSW require it?

  • To keep occupants and first-responders safe

  • To verify critical systems (sprinklers, hydrants, smoke detectors, e-lights, exit doors) actually work

  • To give councils evidence that owners are meeting their obligations under the Building Code of Australia (BCA)

Who can sign an AFSS?

Only an FPAS-accredited Fire Safety Assessor (FSA) or other competent practitioner recognised by NSW legislation can sign.

Owners can confirm credentials on the public
FPAA register.

Key deadlines you need to know

  • Inspection & testing: Up to 3 months before the due date

  • Owner signs & dates AFSS: On or just before due date

  • Lodge with council + FRNSW: Within 7 days of signing

Miss the deadline and councils may issue Fire Safety Orders or hefty fines.

What documents go with the AFSS?

  1. Form 7 – AFSS certificate (current approved form)

  2. Schedule of Essential Fire-Safety Measures

  3. Inspection & test reports (AS 1851 log books, hydrostatic test certificates, etc.)

  4. Form 15 – Competent Fire Safety Practitioner statement (if required)

Five common compliance pitfalls

  1. Unsealed penetrations in fire-rated walls

  2. Expired portable extinguishers or incorrect hose-reel coverage

  3. Missing log-book entries (< 12 months)

  4. Exit doors padlocked or slide-bolted

  5. Incorrect person signing the owner declaration

Avoid these by arranging routine maintenance (AS 1851) plus a pre-AFSS audit at least four weeks before the anniversary date.

Take-away

Submitting an AFSS isn’t just paperwork – it’s proof your life-saving systems work when needed. Stay ahead of fines and Fire Safety Orders by booking your inspection early and choosing an accredited practitioner.

Don’t worry about sounding professional. Sound like you. There are over 1.5 billion websites out there, but your story is what’s going to separate this one from the rest. If you read the words back and don’t hear your own voice in your head, that’s a good sign you still have more work to do.

Be clear, be confident and don’t overthink it. The beauty of your story is that it’s going to continue to evolve and your site can evolve with it. Your goal should be to make it feel right for right now. Later will take care of itself. It always does.
